Chef Taina
Virginia food law
How Virginia's home-kitchen rules apply to qualifying Chef Taina products, direct sales, labeling, and food safety.
Home-kitchen disclosure
Qualifying shelf-stable foods may be prepared under Virginia's home-kitchen inspection exemption. Products sold under that exemption carry the required notice on their package or, when the package is too small, on a sign at the point of sale.
NOT FOR RESALE — PROCESSED AND PREPARED WITHOUT STATE INSPECTION.
The exemption does not prevent Virginia officials from inspecting a home operation after a consumer complaint.
Who may order exempt products
Products sold under the exemption are offered only to individuals in Virginia for their own consumption, not for resale or consignment. Virginia law permits those qualifying products to be ordered online or by phone and delivered in person, by mail, or by a delivery service within the Commonwealth. Chef Taina does not ship exempt products outside Virginia or supply them for resale by restaurants or retailers.
Which foods qualify
The home-kitchen exemption covers the foods listed by Virginia law, including baked goods, only when they do not require time or temperature control for safety after preparation. Refrigerated fillings, meat or poultry dishes, cooked meal-prep foods, and other temperature-controlled products are outside that exemption and may be offered only through the applicable permitted and inspected production path.
Labels and allergens
An exempt product's package or required point-of-sale sign identifies the preparer, contact information, processing date, and statutory disclosure. Product labels also provide the product identity, net quantity, ingredients and subingredients, and required allergen information. Website descriptions are convenient summaries and do not replace the label delivered with the food.
Chef Taina's kitchen handles wheat, eggs, milk, soy, peanuts, tree nuts, and other allergens. We take care with allergy notes but cannot promise an allergen-free environment.
